CONDITIONS OF USE

Welcome to the Equis Menswear website. Our Terms and Conditions become applicable on the entry and use of this website (www.equismenswear.co.uk or www.equismenswear.com) and are detailed below. Please take time to read them carefully as once you enter this website you are requested to read our Terms and Conditions and in using our website signify your agreement to be bound by these Terms and Conditions.

We reserve the right to alter and amend these Terms and Conditions as we see fit and at any time without giving prior notice. Any such changes will apply to orders placed on or after the date your order was placed. For clarification the date your order was placed relates to the date that your order was printed off the website. These Terms and Conditions supercede any other terms and conditions previously published by us and any other representations or statements made by us to you, whether oral, written or otherwise. 

If any of these Terms and Conditions are found to be illegal, invalid or unenforceable by any court of competant jurisdiction, the rest of these Terms and Conditions shall remain in full force and effect.

These Terms and Conditions are governed by the laws of England and Wales and any dispute or claim between the buyer and seller in connection with the use of this website and/or the purchasing of goods from this website will be resolved exclusively in the courts of England and Wales where you and we shall submit to the exclusive jurisdiction of the English courts and law no-matter which country the dispute arises in.

USE OF WEBSITE

We have made every effort to ensure that this website (including the email facility) runs and operates problem and error free but due to the online environment and the technological world that we live in we cannot guarantee that it will not contain viruses or other harmful elements. Because of this you enter our website at your own risk and we will not be held liable for any damages or losses of any kind incurred by entering and using our website and/or the inability to access our website as occasionally the website will be made unavailable due to alterations being made to the website. We will try to keep this down time to a minimum but the website will need to be updated from time to time.

The servicing and upkeep of your PC system being used to access our website is your own cost and responsibility. We cannot guarantee the compatibility of your PC system with our website therefore we accept no liability, without limitation, for any loss or corruption of data, any damage to your system be it hardware or software orientated, or any other loss incurred. The upkeep of your system security in relation to accessing the Internet is your own responsibility and cost.

This website has been designed for the sole operation of Equis Menswear Limited and is intended for your personal, non-commercial use. You may not copy or use any part of this website without the prior written consent of Equis Menswear Limited. MAKING A PURCHASE

The website has been designed to be quick and easy to use. You can either search by product i.e. silk tie or cufflink or by category i.e. equestrian, sport, music etc. If you search by product you will be taken to a category page i.e. music, sport, art etc. in relation to that particular product. If you search by a category, music for instance, the website will display all products relative to that particular category i.e. braces, silk ties, bow ties etc. relative to music. You now also have the option of viewing all products which are listed on the Product Index page situated in the Orange header.

Making a purchase is very easy. As you are browsing through the website click on an item that is of interest to you. This will then take you to another more detailed page (product page) containing additional information and photographs. If you wish to purchase the item then you may have a choice of colour or finish to confirm before clicking the 'Add to Basket' button. On clicking this button a box will come up asking you to click on OK as agreeing that this is the item and then this item is added to a temporary shopping list (View Basket/Checkout) whilst you finish browsing the website. When you have completed your browsing click the 'View Basket/Checkout' button and this will take you through to the next stage of purchasing. The View Basket will list the items that you have chosen giving the product code and description, choice of colour and/or finish and quantity, along with individual prices and a total price as well as offering you a choice of payment (credit/debit card or cheque). If there are items that you wish to amend or cancel you have the opportunity to do so before confirming your payment method. If the information is correct you will then need to click on your preferred method of payment - 'Google Checkout' or 'Pay by cheque'. To pay by credit/debit card you will need a Google Checkout account and your card must be one of those accepted by Google Checkout. If you click on the Google Checkout button it it will take you to an area which will either enable you to log in if you are a member of Google Checkout or will give you the option of opening an account there and then. If you click on the 'pay by cheque' button you will be presented with an on line order form and you will need to complete information fields such as name, address, phone number and email address so we can contact you and know where to send your order. Once completed you will then need to click the 'Generate and print order' button, which will give you the option to print multiple copies. We would suggest printing two copies so that you can send one copy with your payment and the other copy can be kept for your own records. The order form will include such information as your contact details, the amount owed, order number, who to make the cheque payable to (Equis Menswear Ltd) and where to send your order and payment. 

If you print the order form and then change your mind and do not want to complete the transaction then you are free to do so. You are not obligated in any way whatsoever; there is no contract between buyer and seller at this stage.

As some of the products included in the website are fashion related occasionally items will become temporarily out of stock or discontinued. When this happens we will endeavour to correct the website as soon as possible so that you know prior to purchase. Once the item is advertised as being out of stock or discontinued the shopping cart relative to that item will cease to be made available. If however you order an item that is out of stock or has been discontinued before we have been able to put notification on the website we will contact you to inform you of the anticipated delay time, ask if you want to change the item in question to a different item, or we will return your cheque with order or supply a refund (by cheque if paid by cheque) if your payment has been processed and you wished to cancel your order or refund your card through Google Checkout if your card has been charged and you wish to cancel your order. Refunds are only provided on cleared funds and to the invoiced amount.

All prices quoted on the website are inclusive of post and packaging (UK mainland only) as well as VAT (whatever tax rate is applicable at the time of purchase).

Equis Menswear Ltd only process transactions from and in the UK at this moment in time.

Our liability to you in respect of your order (to include delayed, damaged and lost orders) is limited to the value of the order only. We are not liable for consequential loss in any way.

We reserve the right, at our discretion, to refuse to supply goods you order.

If you click the Google Checkout button as your preferred method of payment you will need an account with Google Checkout. We do not require you to provide us (Equis Menswear Ltd) with your credit/debit card details at any time as your card transaction is done through Google Checkout.

We reserve the right to cancel or refuse to supply any orders placed where we have suspicions over the payment or transaction details. If payment has been made and our suspicions have not been satisfied then we reserve the right to cancel the order and provide a refund on cleared funds. We do not require you to provide us with your debit card details.

DELIVERY

There are no delivery charges above and beyond the advertised price to UK mainland destinations relevant to the normal delivery method. We have no control over the postal systems that we use and do not accept responsibility or liability for their failings.

All packages sent within the UK mainland are sent by First Class Royal Mail Recorded Delivery or Special Delivery, which means that they need to be signed for on receipt. If you are not in then a card will be left and you will need to follow the instructions on the card to retrieve your goods.

All packages being sent outside the UK mainland are dispatched by Air Mail Recorded Delivery or Special Delivery, which means that they need to be signed for on receipt. If you are not in then a card will be left and you will need to follow the instructions on the card to retrieve your goods.

Customers ordering outside the UK are liable and responsible for any local import duties, or similar taxes, and may need to contact their local customs office to clarify such charges. Equis Menswear Ltd will not be held responsible or liable for payment of such charges.

All items are sent by a form of Recorded Delivery, which means that they need to be signed for on receipt. We ask that you open the package before signing and inspect the goods to ensure that they have not incurred any damage whilst in transit. Every item will have been 100% quality checked before dispatch. Every item sent will have been sent in an appropriate form of packaging relevant to that item to ensure maximum protection whilst in transit.

You have 24 hours from having received the goods to report goods that have been damaged in transit otherwise any claim will be rejected. If you find the goods to have been damaged on delivery then do not sign for them. Once the goods have been signed for they become your responsibility.

We do not deliver to PO Boxes, maildrop boxes, or forwarding addresses of any kind.

The usual delivery time for stock items (provided they are in stock) is 3-5 days from receipt of order unless otherwise stated in the website. Some items are quoted as having an extended lead-time, please read the product page carefully before ordering or contact us for clarification.

If you wish to find out whether your goods have been dispatched, or when they are due to be, then please contact us stating your name, address, contact details, order number and order details and we will come back to you in due course.

We will make every effort to send the goods out as soon as possible after funds have been cleared and we will endeavour to notify you of a dispatch date if required. If there is a prolonged period until delivery can take place and you find this to be unacceptable then any monies received in relation to the undelivered goods in question can be; returned with order (if paid by cheque), refunded (if payment has been cleared/charged to our account) and the order cancelled, or you can choose an alternative item instead.

If there is undue delay for any reason we will endeavour to notify you using the contact details you have provided. Due to product shortages or late deliveries we cannot be held liable or responsible for any consequential loss incurred due to a late delivery.

CANCELLATION/RETURNS & REFUNDS

If you wish to cancel your order, in full or in part, then please confirm your request by email clearly stating the relevant order number, details of the goods to be cancelled and your name and address. If the goods in question have not been dispatched and your payment hasn't been processed then your payment will either be returned to you along with your order form (if paid by cheque) or cancelled off the Google Checkout system if the payment hasn't been charged. If the payment has been processed a refund (by cheque if paid by cheque or the amount in question will be charged back to the original card used if paid by Google Checkout) will be issued in relation to the item's original sales invoice price only on clearance of the initial payment.

If you have received the goods that you wish to cancel or you have changed your mind and don’t wish to keep them then you will need to notify us as above and send the goods back in their original condition and packaging, preferably by an insured means. You will be responsible for the cost of returning the goods. We cannot issue a refund for goods that arrive back damaged, are not in their original condition, or for goods that we have not received. With this in mind we recommend that suitable protective packaging is used to send the goods back. You have 7 working days after the day after receiving the goods to notify us that you wish to return the goods. If the above criteria is met then a refund will be given.

Certain items may be advertised with ‘an offer’ attached to them. This ‘offer’ may be a free gift i.e. a silk tie of your choice. If an item is to be returned due to you cancelling your order then the free gift must be returned with the item in its original condition and packaging before a refund can be given. If the free gift is not returned or is returned in an unsaleable condition the advertised value of this item, as per this website, will be deducted from the refund. As you are cancelling your order you will be responsible for the cost of returning the goods (including the free gift) back to us.

If a product is found to be genuinely out of the manufacturer’s specification or has a fault in manufacture then you should notify us immediately clearly stating the nature of the complaint. If the complaint is deemed to be justified a refund or exchange will be issued in relation to the initial sales invoice price of the item in question. On agreeing the complaint as being valid then we will send you P&P to enable you to return the goods to us and either a refund or exchange will be issued in relation to the initial sales invoice price of the item(s) in question.

If an item is returned to us because it is at fault and has had a free gift given with it then a refund or replacement product will be offered to the original sales invoice value if the fault is proven to be valid. If a refund is agreed and the free gift has been kept or is found to be unsaleable on its return then the advertised price of this item, as per this website, will be deducted from the refund. If an exchange is agreed to the same sales value, or more, of the faulty item then there will be no need to return the free gift.

Damaged goods will only be replaced if you have notified us as above and have followed our instructions.

If your order has been sent out incorrectly then we will send you P&P to enable you to return the goods to us and either a refund or exchange will be offered.

Where promotions have been applied to orders the refunded amount will be as per the original sales invoice.

Certain items, due to health and safety, cannot be returned or refunded i.e. earrings, personal grooming products unless proven to be faulty. You will be notified of such items.

SECURITY

We do not ask you to create an account where we store your personal data so that you have to use a password to open your account. Every time you enter our website it will be a fresh transaction. There is no requirement to have to ‘log in’ or ‘log out’.

All personal details are treated in the strictest of confidence and will be used for no other reason than the completion of transactions relevant to your order(s). Your information will be made available to no other person(s) other than those that need to be involved in your sale transaction(s). We may use your contact details to send you information regarding the development of the website along with promotional offers or new product lines. This will be a genuine notification of the website’s development and product expansion and may result in a limited number of emails a year. We may also require to contact you for either administrative or operational reasons.

PRICING

Pricing on the website is advertised in GBP Sterling. All prices quoted on the website are inclusive of post and packaging (UK mainland only) as well as VAT (whatever the tax rate applicable at the time of ordering).

All prices are correct at the time of publishing. However, we reserve the right to alter and amend prices at any time and without prior notice.

Although we have made every effort to ensure that all information, including pricing, on this website is correct errors may occur. If we find a pricing error, which is relevant to your order, then we reserve the right to suspend your order and to notify you of the anomaly giving you the option to either pay the correct price or cancel your order. If you wish to cancel your order and the goods in question have not been dispatched and your payment hasn't been processed then your payment will either be returned to you along with your order form (if paid by cheque) or cancelled off the Google Checkout system if the payment hasn't been charged. If the payment has been processed/charged a refund (by cheque if paid by cheque or the amount in question will be charged back to the original card used if paid by Google Checkout) will be issued in relation to the item's original sales invoice price only on clearance of the initial payment. We will not be obliged to supply goods at the incorrect price.

WEBSITE ALTERATIONS & ERRORS

Our aim is to offer you the very best choice and range of product available. This will mean additions and deletions to the range of products on offer therefore we cannot guarantee that what you have seen previously will still be available at a later date. We reserve the right to alter our website without prior consent, warning or notice.

We endeavour to ensure that our website is free from errors, be they typographical, colour, measurement, price or any other inaccuracies. However, despite this, errors may occur from time to time for which we apologise. We reserve the right to correct any errors/inaccuracies without prior notice and at our own discretion.

HEALTH & SAFETY

Equis Menswear can not be held responsible or liable in any way and without limitation for people using the products on this site in a manner which they are not designed to be used for. It is the purchaser's responsibility to use and store their purchases in a manner so as to prevent harm to anyone/anything who may come into contact with them.

Equis Menswear will not be held responsible or liable, without limitation, in any way for someone having any form of reaction, including an allergic reaction, to any of the products purchased from this website. 

WEBSITE PHOTOGRAPHY/PRODUCT DISPLAY

We have endeavoured to replicate the colour and features of the products on offer to the best of our ability, however we cannot guarantee that your PC system will replicate the texture, colour or detail as accurately/the same as the original artwork used by us, therefore we cannot be held responsible for the limitations or differences of your system and how it portrays the images included on our site.

The photography has been taken to best portray the colour and design of the products on offer. Due to light and colour variances and whilst our suppliers are working within a tolerance of manufacture we cannot guarantee that the product delivered will be exactly the same colour/shade as that advertised. For instance, products can look different under different forms and strengths of internal lighting compared to natural light and can look very different when viewed internally as opposed to externally in sunlight or shade. Descriptions of all our goods are for guidance only and there may be a small variation in colour, finish and dimensions.

We have tried to make your shopping experience as easy and enjoyable as possible by the inclusion, where deemed appropriate, of dimensionalised images. These are given as a guide to assist you in your choice of size. The dimensions have been taken from the actual manufacturers’ products. Please bear in mind that the manufacturer has to work within a tolerance therefore the measurements displayed will not be replicated every time, there may be a variance from batch to batch. As this is the case you will need to accept that there may be variation from the dimensions shown to the actual garment delivered.

The product packaging may also vary from time to time dependant upon availability. Every effort will be made to ensure that the packaging the product is sent in is the same as that advertised on the website. There will be a variance in the silver coloured cufflink boxes as the colour of fabric used within the box can vary from box to box. We will not accept cancellations or refunds for this reason.

Cookies are small text files that identify your computer to our server, which also contain data as to where you have visited on our site. They provide us with useful information that helps us make our site more accessible to our users. These cookies do not allow us to access your computer.
